Terms of Use

Welcome to Recap — a place for memories with friends. These Terms of Use (the "Terms") are a legal agreement between you and Recap d.o.o., a company registered in Slovenia ("Recap", "we", "us"), and govern your use of the Recap mobile application, the website at therecap.app, and related services (together, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which explains how we handle your data. If you do not agree, please do not use the Service.

1. What Recap Is

Recap lets you and your friends collect shared moments in one place. You create or join shared spaces ("Recaps"), add your photos, videos, and messages, and see your friends' points of view ("POVs") of the same moments. There is no algorithmic public feed and no advertising — the Service is built for sharing between friends.

You are responsible for your account and everything that happens under it. Keep your password secure, and tell us right away at info@therecap.app if you suspect unauthorized access. We may suspend or refuse accounts that violate these Terms or put other users at risk.

It stays yours

You own the photos, videos, messages, and other content you create or share on Recap ("Your Content"). We claim no ownership of it.

The permission you give us

So that the Service can work, you grant Recap a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process (for example resizing or encoding), and display Your Content — solely for operating, providing, securing, and improving the Service, and only as directed by you and your settings. This license ends when you delete Your Content or your account, except where content has been shared with others who still have it (see below), where deletion is technically delayed for a limited period (such as backups), or where we must retain it by law. We do not sell Your Content and we do not use it for advertising.

Sharing with friends

Recaps are shared spaces. When you add content to a Recap, the members of that Recap can view it, and — depending on features and settings — react to it, save it, or add it to their own copies of the shared memory. Choose your Recaps and friends accordingly. You are responsible for what you share.

What you promise about Your Content

You confirm that you have the necessary rights to the content you share, that it does not infringe anyone's rights (including copyright, privacy, and personality rights of people who appear in it), and that it complies with these Terms. When you share photos or videos of your friends, make sure they are okay with it.

6. Content Moderation and Reporting

We may review, restrict, or remove content that we reasonably believe violates these Terms or applicable law, and we may suspend or terminate accounts involved. You can report content or behavior directly in the App or by emailing info@therecap.app — this address is also our single point of contact for authorities and users under the EU Digital Services Act. If we restrict your content or account, we will inform you of the reason where the law requires, and you can object by contacting us.

7. Intellectual Property of Recap

The Service — including the App, website, design, logos, and software — is owned by Recap d.o.o. or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on your devices for your personal use, in accordance with these Terms and the rules of the app store you downloaded it from. If you send us feedback or suggestions, we may use them without obligation to you.

8. Copyright Complaints

If you believe content on Recap infringes your copyright, email info@therecap.app with: (a) identification of the work; (b) the location of the allegedly infringing content; (c) your contact details; (d) a statement that you believe in good faith the use is unauthorized; and (e) a statement, under penalty of perjury, that your notice is accurate and that you are the rights holder or authorized to act for them. We will remove or disable access to infringing content and may terminate repeat infringers' accounts.

9. Third-Party Services and App Stores

The App is distributed through the Apple App Store and Google Play. Your use of those platforms is also subject to their terms, and app store providers are not responsible for the Service and have no obligation to provide support or maintenance for it. If you downloaded the App from the Apple App Store: these Terms are between you and Recap only, not Apple; Apple has no warranty, support, or other obligations with respect to the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.

We work hard to make Recap great, but the Service is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that content will never be lost — please keep your own copies of memories that matter to you. Nothing in these Terms limits any statutory rights you have as a consumer, including under EU and Slovenian consumer protection law.

12. Limitation of Liability

To the extent permitted by law, Recap will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. To the extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of €50 or the amount you paid us (if any) in the 12 months before the claim. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including liability for intent or gross negligence, or for death or personal injury.

13. Indemnification

To the extent permitted by law, you agree to indemnify Recap against claims by third parties arising from Your Content or your breach of these Terms, except to the extent the claim results from our own fault. This section does not apply where prohibited by the consumer laws of your country.

14. Changes to the Service and These Terms

Recap evolves — we may add, change, or remove features. We may also update these Terms; if we make material changes, we will notify you in the App or by email before they take effect. If you continue using the Service after the changes take effect, the updated Terms apply. If you do not agree, you may delete your account.

15. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Slovenia, without prejudice to mandatory consumer protections of the country where you live — if you are an EU consumer, you keep the protections of your home country's law and may bring claims before your home courts. Otherwise, disputes will be resolved by the competent court in Ljubljana, Slovenia. We would rather solve issues directly — write to us first at info@therecap.app.
